Terms of Service

Welcome to WorldCircle. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and The Fluxone Inc. ("we," "us," or "Company") governing your access to and use of the WorldCircle mobile application (the "App"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App.
• If you are under 18 (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian.
• By creating an account, you represent that the information you provide is accurate, complete, and current.

2. Account Registration & Security

• You must provide a valid email address, phone number, username, and password to register.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at support@thefluxone.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use WorldCircle in a lawful and respectful manner. You shall not:

• Post, send, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Send spam, unsolicited advertisements, or promotional materials.
• Upload files containing viruses, malware, or any code designed to disrupt, damage, or limit the functionality of any software or hardware.
• Attempt to gain unauthorized access to other users' accounts, our servers, or any systems connected to the App.
• Collect or harvest personal information of other users without their consent.
• Use the App for any commercial purpose without our prior written consent.
• Interfere with or disrupt the App, servers, or networks connected to the App.
• Circumvent, disable, or otherwise interfere with security or access-control features of the App.
• Use automated means (bots, scrapers, crawlers) to access, interact with, or extract data from the App.

4. User-Generated Content

4.1 Ownership

You retain ownership of the content you create and share through the App, including text messages, images, voice recordings, and files ("User Content"). By posting User Content, you grant The Fluxone Inc. a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App.

4.2 Content Standards

You are solely responsible for your User Content. We do not endorse, verify, or guarantee the accuracy of any User Content. We reserve the right (but have no obligation) to review, remove, or disable access to any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

4.3 Reporting

If you encounter content that violates these Terms, you may report it using the in-app reporting feature. We will review reports and take appropriate action, which may include content removal and account suspension or termination.

5. Subscriptions & In-App Purchases

5.1 Free Trial

We may offer a free trial period for premium features. Trial eligibility is limited to one trial per device. Abuse of the trial system (including using multiple devices or accounts to obtain additional trials) may result in account suspension.

5.2 Paid Subscriptions

• Subscriptions are billed through Apple App Store or Google Play Store. By subscribing, you agree to the terms and pricing presented at the time of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's App Store or Google Play settings.

5.3 Refunds

All purchases are processed by Apple or Google. Refund requests must be directed to the respective platform:

• Apple: Request a refund from Apple
• Google: Request a refund from Google Play

6. Community Guidelines & Moderation

• Users who violate our Acceptable Use policy may receive warnings, temporary bans, or permanent account termination.
• Repeated violations or severe offenses (including but not limited to harassment, hate speech, sharing of illegal content, or threats of violence) may result in immediate permanent ban without prior warning.
• We log moderation actions (ban type, reason, date) for accountability and appeals.
• If you believe a moderation action was taken in error, you may appeal by contacting support@thefluxone.com.

7. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is the property of The Fluxone Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FLUXONE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Fluxone Inc. and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

12. Termination

• You may stop using the App and delete your account at any time by contacting support@thefluxone.com.
• We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.
• Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Sections 9, 10, 11, 13, and 14) will survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Fluxone Inc. regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or by email. Your continued use of the App after such changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
